Mesuji – (SIN) – Kejaksaan Negeri (Kejari) Mesuji dinilai kelabakan lantaran pemberitaan wartawan di beberapa media online terkait adanya dugaan lembaga Adhyaksa itu bungkam soal dugaan permasalahan Dana Desa di Kabupaten Mesuji yang diduga kuat telah di manfaatkan oleh Adepsi Kabupaten setempat demi merauk keuntungan pribadi atau berjamaah.
Pasalnya, Kejari Mesuji melalui Ardi Herliansyah, SH.MH (Kasi Intel) diyakini kelabakan dikarenakan mengeluarkan pernyataan mengarah ancaman atau langkah hukum (Upaya pidana) bagi awak media yang berusaha membongkar dugaan kasus dalam permasalahan dimaksud.
Ardi Herliansyah dikutip melalui https://radarmetro.disway.id/read/4346/pasal-pelatihan-hukum-apartur-desa-kejari-mesuji-hanya-undangan, mengatakan bahwa Kejaksaan Negeri Mesuji merespon cepat terkait pemberitaan salah satu media online yang terkesan tendensius dan tak mendasar. Bahkan terkesan melakukan pencemaran nama baik korps Adhiyaksa dan dilakukan tanpa ada klarifikasi dari narasumber. Atas hal tersebut pihak Kejaksaan Negeri Mesuji selain melakukan klarifikasi juga akan mempertimbangkan menempuh jalur hukum sebagai langkah penyelesaian.
“Kami berkeberatan dengan pemberitaan yang kesannya tendensius, penggunaan Bahasa yang kasar, tidak beretika dan menjurus ke fitnah tanpa adanya klarifikasi dari narasumber dengan menggunakan etika jurnalistik yang sepatutnya. Bahwa untuk hal tersebut, kami akan menggunakan hak jawab dan sedang mengkaji apakah kantor berita dan wartawan yang bersangkutan terdaftar secara resmi sebagaimana telah diatur dalam UU tentang Pers dan apabila resmi kami mempertimbangkan untuk memasukkan pengaduan kepada Dewan Pers tentang adanya kode etik Pers yang dilanggar serta apabila tidak resmi maka kami akan melakukan kajian terkait dengan adanya unsur pidana dalam hal ini fitnah yang untuk kami jadikan pertimbangan untuk mengambil Langkah Hukum,” Tegas Kepala Seksi Intelegen (Kasi Intel) Kejaksaan Negri Mesuji Ardi Herliansyah, Jumat (12/01/2023).
Jika mencermati upaya yang dilakukan Ardi Herliansyah, hal ini merupakan kurang pantas untuk dilakukannya. Mengingat Ia adalah aparatur penegak hukum yang mestinya melakukan penyelidikan dan penyidikan terhadap dugaan permasalahan tersebut, dan bukan melakukan intervensi atau penekanan terhadap awak media yang berusaha menginformasikannya.
Apalagi sebelumnya, pihak Kejari Mesuji melalui Kasi Intel (Ardi Herliansyah, SH.MH) juga telah beberapa kali dimintai informasi atau keterangan oleh awak media yakni dimulai pada Minggu (07/01/2024) – Kamis (11/01/2024), terkait kebenaran hadir pihaknya sebagai narasumber kegiatan penyuluhan hukum aparatur desa di GSG Taman Kehati tahun 2023, hingga mempertanyakan nama yang hadir, dan lama waktu jam kehadiran dalam memberikan materi sebagai narasumber, termasuk bertanya tentang jumlah honorarium yang diterima pihaknya.
Bahkan dipertanyakan pula mengenai tindaklanjut, menyikapi dugaan permasalahan pengelolaan dana desa kabupaten Mesuji oleh Apdesi wilayah setempat, namun Ardi Herliansyah hingga berita dipublikasikan dia tidak mau memberikan informasi atau keterangan sebagaimana dimaksud.
Selain itu, Ardi Herliansyah dinilai juga kurang pas dan salah alamat dalam memberikan klarifikasi pada media lain yang tidak memuat pemberitaan tentang pihaknya. Akan tetapi Ardi Herliansyah tidak melakukan hal ini, justru melakukan kekeliruan lain dengan cara terindikasi menakut-nakuti wartawan.
Terpisah, Lembaga Bantuan Hukum Persatuan Wartawan Republik Indonesia lampung (LBH-PWRI) Yanuar Zuliansah, S.H, sesalkan langkah – langkah Kasi Intel Kejari Mesuji, Ardi Herliansyah yang tertutup terhadap informasi publik terkait dugaan permasalahan pengelolaan dana desa oleh Apdesi, yang melibatkan pihaknya pada kegiatan penyuluhan hukum aparatur desa di kabupaten Mesuji.
Menurut Yanuar Zuliansah, S.H,
Kasi Intel Kejari Mesuji seharusnya memberikan informasi yang dibutuhkan wartawan sebagai tindaklanjut pemberitaan, agar supaya adanya perimbangan dalam pemberitaan yang akan terkonsumsi dan dinilai publik.
“Sangat kami sesalkan, ada apa lho dengan pihak Kejari Mesuji ini. Apakah ada sesuatu yang tersimpan maka mereka tidak mau memberikan informasi yang dibutuhkan wartawan untuk disampaikan ke publik. Dan kami juga menjadi tanda tanya, apalagi pihak Kejari terlibat sebagai narasumber. Seyogyanya mereka harus memberikan informasi itu, apalagi UU KIP sudah jelas dengan amanatnya. Artinya jangan salahkan wartawan kalau pemberitaan tidak sesuai, itu semua karena kalian yang tertutup informasi,” Ungkap Dia sikapi permasalahan tersebut.
“Harus relevan hak jawab, atau koreksi yang diberikan. Hak jawab atau koreksi itu pun sewajarnya melalui media yang memuat pemberitaan, bukan melalui media lain. Dan kami ingatkan, kalian pihak Kejari adalah penegak hukum yang diambil sumpah jabatan dan dibayar pakai uang rakyat. Jadi laksanakan tugas kalian dengan sebenar – benarnya, dan bukan mengintimidasi atau menekan para penyaji informasi secara halus seperti itu,” Pintanya.
