Karawang-Jabar – (SIN) – Sejumlah persoalan telah muncul di dalam pelaksanaan proyek rehabilitasi gedung kantor Kecamatan Jayakerta Kabupaten Karawang yang saat ini dikerjakan oleh CV. Gemilang, seperti adanya perubahan perencanaan awal, pekerja yang tidak menggunakan Alat Pelindung Diri (APD), hingga penggunaan layanan listrik yang tidak resmi oleh pihak pelaksana terus mencuat.
Selain itu berdasarkan informasi yang dihimpun awak media pihak pelaksana dan pihak Dinas PUPR bahkan juga diduga telah melanggar Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah, Peraturan LKPP Nomor 9 Tahun dan Peraturan LKPP No. 9 Tahun 2018 tentang Pedoman Perencanaan Pengadaan Barang/Jasa Pemerintah.
Pasalnya, pihak pelaksana pekerjaan ( Fauzi ), untuk memenangkan tender dan melaksanakan proyek rehabilitasi gedung kantor Kecamatan Jayakerta itu pun diduga dengan cara meminjam ataupun menyewa CV (Bendera) dari pemilik CV. Gemilang berinisial H.
Hal itu pun dibenarkan oleh sang pemilik CV. Gemilang saat ditanya awak media melalui layanan pesan whattApps baru-baru ini.
” Bukan, itu kerjaan H Fauzi. CV nya sewa ke saya,” singkat H kepada Awak media.
Padahal, sebelumnya Deputi Bidang Hukum Dan Penyelesaian Sanggah, Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP) Setya Budi Arianta menjelaskan praktik pinjam pakai CV (Bendera) melanggar tiga ketentuan.
Pertama, melanggar prinsip dan etika pengadaan sebagaimana diatur dalam Pasal 6-7 Perpres No. 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah. Pasal 7 mengharuskan semua pihak yang terlibat PBJ mematuhi etika, termasuk mencegah pemborosan dan kebocoran keuangan negara.
Kedua, melanggar larangan membuat dan memberikan pernyataan tidak benar atau memberikan keterangan palsu, sesuai Peraturan LKPP No. 9 Tahun 2019.
Ketiga, menabrak larangan mengalihkan seluruh atau sebagian pekerjaan kepada pihak lain, sebagaimana diatur dalam Peraturan LKPP No. 9 Tahun 2018 tentang Pedoman Perencanaan Pengadaan Barang/Jasa Pemerintah.
“Pinjam bendera sudah dipastikan melanggar ketentuan,” tegas Setya Budi Arianta saat menjadi pembicara dalam webinar Pekan Merdeka Pengadaan yang diselenggarakan Lembaga Kebijakan Pengadaan Barang/Jasa Pemerintah (LKPP).
