Sidang Perdana Pengajuan PK di PN Gunung Sugih, Candra Guna Serahkan Novum.

Gunung Sugih – (SIN) – Pengadilan Negeri (PN) Gunung Sugih laksanakan sidang perdana pengajuan Peninjauan Kembali (PK) Kasus Pidana dengan Pemohon terpidana Afrizal, Rabu (30/8/2023) di Pengadilan Negeri Gunung Sugih.

Sidang yang dipimpin hakim ketua Restu Iklas, S.H., M.H didamping dua orang hakim anggota, Anugrah R* Lalana Sebayang, S.H., S.T., MH dan Yoses Karismanta Tarigan, S.H., M.H melaksanakan pemeriksaan berkas terkait dengan alasan pengajuan PK yang dilakukan oleh pemohon terpidana Afrizal.

Hal tersebut disampaikan Yoses Karismanta Tarigan, S.H,.M.H selaku Humas Pengadilan Negeri Gunung Sugih yang juga Hakim Anggota dalam Sidang Perdana tersebut.

“Hari ini kita melaksanakan sidang perdana terkait pengajuan PK yang dimohonkan oleh Terpidana Afrizal. Dalam sidang tersebut kita melakakan pemerikasaan berkas terkait Novum (Alat bukti baru) yang diserahkan oleh pemohon melalui kuasa hukumnya.” Jelas Yoses.

Lanjutnya, setelah dilakukan pemeriksaan, akan dilakukan penandatanganan berita acara pemeriksaan yang akan dilaksakan pada hari Senin, (4/9/2023).

“Setelah dilakukan pemeriksaan tadi dan hakim juga sudah menanyakan apakah ada tambahan alat bukti kepada pemohon atau termohon dan jawabannya sudah tidak ada. Maka proses tadi itu akan dituangkan dalam proses penandatanganan berita acara pemeriksaan yang akan dilaksanakan pada hari Senin besok.” Terangnya.

Sementara kuasa hukum terpidana Afrizal alias AFrizal Alfarizi, Candra Guna, S.H membenarkan hari ini telah dilaksanakan sidang perdana pengajuan PK atas nama Aprizal di PN Gunung Sugih, dimana dalam sidang tersebut pihaknya telah menyerahkan Novum.

Canda menjelaskan pada tahun 2017 lalu, Pengadilan Negeri Gunung Sugih telah memutuskan terdakwa Aprizal dinyatakan bebas dengan putusan nomor 228/Pid.B/2017/PN. Gns tanggal 30 Oktober 2017. Namun terkait putusan tersebut, JPU mengajukan Kasasi ke Mahkamah Agung RI dan akhirnya memutuskan klaen kami bersalah dan dihukum 18 tahun penjara dengan putusan Nomor 295 K/Pid/2018 tanggal 28 Juni 2018.

Terkait permasalah tersebut, pihaknya telah menemukan bukti baru (Novum) untuk mengajukan PK dalam kasus terpidana Aprizal. Dimana ada kesaksian dari terpidana utama dalam kasus tersebut telah mengakui ada paksaan penyebutan nama Aprizal oleh oknum penyidik.

“Kita lakukan PK ini karena adanya Novum dan saksi dalam perkara ini. Pengakuan terpidana atas nama Haris Sanjaya telah dipaksa untuk menyebutkan nama klaen kita oleh oknum penyidik dan itu sudah tertuang dalam Novum yang kita ajukan tadi,” jelas Candra.

Candra menambahkan, selain adanya bukti baru tersebut, setelah pihaknya menelaah dan membaca hasil putusan Mahkamah Agung RI terkait putusan kakasi yang diajukan PJU adanya kehilafan Hakim Agung dalam mengambil keputusan. Dan terdapat perbedaan pendapat (dissenting opinion) antara tiga Hakim agung dalam putusan hakim Mahkamah Agung RI dengan nomor 295 K/Pid/2018 tanggal 28 Juni 2018.

“Disini ada Dissenting Opinion antara Hakim Agung dalam amar putusan tersebut. Dimana Hakim Agung Dr. Gazalba Saleh, S.H,. M.H berpendapat sama dengan putusan Pengadilan Negeri Gunung Sugih. Sedangkan dua Hakim Agung lainnya berpendapat berbeda, karena kalah suara jadi keluarlah putusan tersebut.” Pungkasnya. (*)
